NOTICE OF PUBLIC WORKSHOP
NOTICE IS HEREBY GIVEN; the Nevada Division of Public and Behavioral Health will hold a public
workshop to consider amendments to Nevada Administrative Code (NAC) 440 Vital Statistics, as set
forth in LCB File No. R111-22. The workshop will be conducted on site and via videoconference
beginning at 11:00 am on November 14, 2022, at the following locations:

The proposed changes will revise Chapter NAC 440 of the Nevada Administrative Code and are
being proposed in accordance with Nevada Revised Statues (NRS) 440.285, 440.303, 440.380,
440.420, 440.430, 440.490, 440.540, 440.620, 440.690, and NRS 440.700.
The proposed regulations provide provisions for the following:
The proposed addition/change of regulations in LCB File No. R111-22 include:
Clarifying the English Replacement of a Foreign Birth Certificate
Clarifying ID requirements for Declarations of Paternity/Parentage
Clarifying how to fill out the cause of death
Aligning deadlines for medical certifiers to sign death certificates with existing law
Clarifying who is responsible to sign a death certificate once the coroner relinquishes
jurisdiction
Clarifying the responsibility of transferring death records from one funeral home to
another
Clarifying gender identity options and the evidence needed to change it once the record
has been registered
Clarified the delayed birth process and evidence required
Clarified the non-refundable status of fees once services have been rendered
Removal of the notary services from regulation
The Division is bringing forward this change to clarify regulations as instructed by the Nevada
State Legislature’s Sunset Committee.

2. These proposed regulations will not add any costs to the current regulatory enforcement
activities conducted by the Division of Public and Behavioral Health. Additionally, the proposed
regulations do not provide for a new fee or increase any existing fee.
The proposed regulations are not duplicative or more stringent than any federal, state, or local
standards.
